  • Small law firms present their own unique set of insurance issues and challenges . . .

  • The fact is that some insurance carriers simply do not wish to insure small firms, regardless of the nature of the practice.  In speaking with various underwriters about this issue, it appears that they are concerned that small firms often take on a greater caseload than they can reasonably handle, and that some small firms will accept cases that are outside their normal areas of expertise.  Sometimes, this is due to a desire to maintain or expand an existing client relationship; sometimes it is simple economics - a firm might find itself at a point where there are few active matters, and it is only human nature to want to take whatever next comes through the door.  Obviously, either situation can result in a professional liability claim.  
  • Another underwriting concern with small firms - and solo's in particular - is that should the attorney become involved in a lengthy trial, or should he or she fall ill or otherwise be unable to pay adequate attention to the daily operations of the practice, who will respond to new - and possibly unexpected - developments in existing cases, or urgent inquiries from new or existing clients?  In fact, virtually every insurance carrier requires a solo to provide the name, address and telephone number of an attorney who can be contacted in the insured's absence.  
  • On the other hand, some underwriters are not only comfortable with small firms, but even actively pursue this particular niche.  And, for obvious reasons, the more an underwriter understands and is comfortable with a risk, the more competitive he or she will be when offering terms.
